These Terms and Conditions ("Terms") govern the sale of vehicle lifts, accessories, and related equipment ("Products") by Automotive Lift Services ("Seller", "we", "us") to the purchaser ("Buyer", "you"). By placing an order on store.autoliftserv.com, in person, by phone, or by any other channel, Buyer agrees to be bound by these Terms.
1. Acceptance of orders
1.1 All orders are subject to acceptance by Seller. Seller reserves the right to refuse any order for any lawful reason, including but not limited to product availability, pricing errors, suspected fraud, geographic restrictions, or inability to meet manufacturer requirements.
1.2 Pricing displayed on store.autoliftserv.com reflects current MAP (Minimum Advertised Pricing) compliance and dealer cost markups in effect at the time of listing. Prices are subject to change without notice. Seller will honor the price displayed at the time Buyer's order is placed and payment is captured, except in cases of obvious pricing errors (≥30% deviation from typical street price), in which case Seller will contact Buyer to confirm or void the order.
1.3 "Call for Pricing" items require Buyer to contact Seller directly. Seller will provide a written quote valid for 30 days from issue.
1.4 Manufacturer tariff surcharges (such as the May 2026 Devon Industries surcharge on Blazer 9000 lifts) are passed through to Buyer at the time of order. Surcharges are non-negotiable and may be added or removed at the manufacturer's discretion. Seller is not responsible for surcharge fluctuations.
2. Payment
2.1 Seller accepts the following payment methods:
- **Credit Card** processed via Stripe (Visa, Mastercard, American Express, Discover)
- **ACH bank transfer** processed via Stripe ACH (US bank accounts only — typically clears in 3-5 business days)
- **Wire transfer** for orders over $25,000 (contact us for wire instructions)
- **Approved net-30 terms** for established commercial accounts (subject to credit application and approval)
2.2 Full payment is required prior to shipment unless net terms have been approved in writing.
2.3 ACH bank transfers must clear before shipment is released. Allow 3-5 business days for ACH clearance.
2.4 Credit card transactions are subject to a processing fee of 2.9% + $0.30 per transaction, which is included in the displayed price. ACH and wire transfers carry no processing fee.
2.5 Declined or reversed payments will void the order, and Buyer will be liable for any restocking, shipping, or return freight costs already incurred.
3. Shipping and delivery
3.1 **Freight terms.** Most lifts ship freight prepaid via common carrier (typically ABF, FedEx Freight, or YRC). Freight is included in the displayed product price unless otherwise stated.
3.2 **Lead times.** Standard lead times vary by manufacturer and product. Seller will provide an estimated lead time at order confirmation. Lead times are estimates only and not guaranteed. Manufacturer delays, weather, or freight network disruptions may extend lead time.
3.3 **Delivery.** Standard delivery is to the curb or the closest accessible point to Buyer's address. Liftgate service, residential delivery, limited-access delivery, and inside delivery are available at additional cost — Buyer must request these in advance.
3.4 **Buyer's responsibility on delivery.** Buyer (or Buyer's representative) MUST be present at delivery to:
- (a) Inspect the shipment for visible damage before signing the bill of lading
- (b) Note any damage, shortage, or discrepancy ON the bill of lading at the time of receipt
- (c) Photograph any damaged packaging or product before signing
Failure to note damage on the bill of lading at delivery may void freight claims and reduce or eliminate Seller's ability to obtain replacement parts or refunds from the carrier. Per manufacturer terms (Devon Industries, Challenger Lifts, Rotary, BendPak, Atlas): "It is difficult to collect for loss or damage after you have given the carrier a clear receipt."
3.5 **Hidden damage.** If damage is discovered after delivery, notify Seller within 7 days of receipt with photographs. Seller will work with the carrier and manufacturer to remediate.
3.6 **Risk of loss** passes to Buyer upon delivery to Buyer's specified address (or to the carrier, in the case of Buyer-arranged freight).
3.7 **Inspection.** Buyer shall inspect goods upon receipt and notify Seller of any defects or discrepancies within 7 days. Failure to notify within this window constitutes acceptance.
4. Installation
4.1 Seller offers professional installation coordination as a separate service (see Install Coordination page). Buyer may also self-install or hire an ALI-certified local installer.
4.2 **Installation by non-ALI-certified personnel may void the manufacturer's warranty.** ALI certification (Automotive Lift Institute) is the industry standard for safe and warranted installation. Devon Industries, Rotary, Challenger Lifts, and BendPak all reference ALI-certified installation in their warranty terms.
4.3 **Buyer is responsible for providing the proper installation site:**
- (a) Concrete floor meeting the manufacturer's specifications (thickness, PSI rating, cure time, levelness, edge distance from cracks and joints) as documented in the Product's Installation, Operation, and Maintenance Manual ("IOM")
- (b) Electrical service meeting the Product's voltage, amperage, and phase requirements
- (c) Compressed air supply (where required) meeting the Product's PSI and CFM specifications
- (d) Adequate bay dimensions, ceiling clearance, and overhead obstruction-free space
- (e) Building permits and inspections where required by state or local code
4.4 **Seller is not liable for property damage, vehicle damage, personal injury, or unsatisfactory lift performance resulting from inadequate installation site, including but not limited to insufficient concrete, improper electrical, or failure to follow manufacturer's IOM instructions.**
4.5 The Fit Check service offered by Seller (free pre-purchase site evaluation) is an advisory service designed to help Buyer assess whether their site meets manufacturer requirements. The Fit Check is not a substitute for professional engineering, contractor inspection, or building code compliance. Seller's recommendations are based on information provided by Buyer and are made in good faith but do not constitute a warranty.
5. Warranty
5.1 **Manufacturer warranty applies.** Each Product carries the manufacturer's standard warranty as published by the manufacturer at time of sale. Warranties typically include:
- **2-year structural** warranty on lift columns, runways, and frames
- **1-year hydraulic** warranty on cylinders, power units, hoses, and seals (some manufacturers offer longer)
- **Specific exclusions** vary by manufacturer (consult the Product's warranty document for full terms)
5.2 **Warranty registration.** Buyer is responsible for completing warranty registration directly with the manufacturer within 30 days of installation. Seller will assist with registration upon request.
5.3 **Conditions for warranty validity:**
- Installation by an ALI-certified installer (in most manufacturers' terms)
- Compliance with the IOM specifications (concrete, electrical, air, anchor torque)
- No modifications, unauthorized repairs, or use beyond rated capacity
- Annual inspection per ANSI/ALI ALOIM standards
- Notification of any defect to the manufacturer within the warranty period
5.4 **Voiding events:** Buyer's warranty may be voided by:
- Exceeding the Product's rated capacity
- Use on inadequate concrete or surface (asphalt, dirt, etc.)
- Installation by an unqualified party (where ALI certification is required)
- Failure to perform required annual maintenance and inspection
- Modification of operating controls or safety systems
- Use outside the recommended operating temperature range (typically 41-104°F / 5-40°C for indoor lifts)
5.5 **Seller's role.** Seller will assist Buyer with warranty claims by coordinating with the manufacturer. Seller is not the warrantor of manufacturer products; the manufacturer is solely responsible for warranty repair, replacement, or reimbursement.
5.6 **Items NOT covered by warranty** (per industry standard):
- Normal wear and tear
- Damage from improper installation, abuse, misuse, overloading, or negligence
- Concrete floor failures or installation site deficiencies
- Freight damage (covered under freight claims, not warranty)
- Consumable items (hydraulic oil, rubber pads after normal wear, etc.)
6. Returns and refunds
6.1 **All sales are FINAL on custom and made-to-order Products,** including but not limited to:
- All inground lifts (Rotary SmartLift family) — these are manufactured to order with site-specific containment
- Color-specific variants (Blazer Red, Rotary Blue, BendPak custom finishes)
- Wide SmartLift variants (SLW210-AV, SLW212-AV) — built per pit specifications
- Custom voltage configurations
6.2 **Standard returns** on non-custom Products are accepted within 30 days of receipt, subject to:
- (a) Product must be in original, unused, undamaged condition with all original packaging, manuals, and accessories
- (b) Buyer must obtain a Return Merchandise Authorization (RMA) from Seller before shipping back
- (c) Buyer is responsible for return freight (typically $500-$2,500 depending on lift size and origin)
- (d) **Restocking fee of 25%** of the product price will be deducted from the refund
- (e) Refunds are processed within 14 business days of Seller's receipt and inspection
6.3 **Damaged-on-arrival returns** (when freight damage is properly documented on the bill of lading per Section 3.4): Seller and the manufacturer will work to either repair, replace, or refund at no cost to Buyer. Buyer must preserve all packaging and damaged product for inspection.
6.4 **Refused shipments** (Buyer refuses delivery without prior authorization) are subject to a 50% restocking fee plus actual round-trip freight charges.
6.5 No returns are accepted on opened consumables, used hydraulic oil, or any product that has been installed.
7. ALI certification and compliance
7.1 The Automotive Lift Institute (ALI) maintains industry-standard safety certifications for vehicle lifts. Most Products on store.autoliftserv.com are ALI-certified (specifically tagged "ALI Certified" or "ALI GOLD Certified" on the product page).
7.2 Some products are **not** ALI-certified by design (Atlas Garage Pro home storage line is hobbyist-rated, not ALI-validated). These products are clearly marked. Buyer is responsible for confirming whether their insurance carrier, state regulator, or municipal permit office requires ALI certification before purchase.
7.3 ALI certification status is set by the manufacturer, not by Seller. If ALI certification matters to Buyer, Buyer must verify with the manufacturer before purchase.
8. Intellectual property
8.1 All manufacturer trademarks, product images, manuals, and marketing materials referenced or displayed on store.autoliftserv.com are the intellectual property of their respective owners (Challenger Lifts, Rotary Solutions, BendPak/Ranger, Atlas Automotive Equipment, Devon Industries, and their parent companies).
8.2 Seller is an authorized distributor and uses these materials with manufacturer permission. Buyer may not reproduce, redistribute, or commercially use any content from store.autoliftserv.com without written permission.
8.3 The autoliftserv.com brand, AutoLift Services name, and the customer-facing copy, layouts, and Fit Check process are the intellectual property of Automotive Lift Services.
9. Limitation of liability
9.1 **Maximum liability.** Seller's total liability for any claim arising from or related to the sale of a Product, regardless of the form of action (contract, tort, warranty, or otherwise), shall not exceed the purchase price paid by Buyer for that specific Product.
9.2 **Exclusion of consequential damages.** In no event shall Seller be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to lost profits, loss of business, loss of use, damage to other property, downtime, or personal injury, regardless of whether Seller has been advised of the possibility of such damages.
9.3 **Buyer's assumption of risk.** Buyer acknowledges that vehicle lifts are heavy industrial equipment that operate at significant hydraulic pressures and lift substantial loads. Operator training, regular maintenance, and adherence to the IOM and ANSI/ALI standards are mandatory for safe operation. Buyer assumes all responsibility for safe installation, operation, maintenance, and inspection of Products purchased.
9.4 **Independent professionals.** Buyer is encouraged to retain qualified electricians, ALI-certified installers, structural engineers, and concrete contractors for all installation work. Seller is not a substitute for these qualified professionals.
10. Data and privacy
10.1 Seller collects only the information necessary to process Buyer's order, deliver Products, provide customer service, and (with Buyer's consent) send marketing communications.
10.2 Seller does not sell or rent Buyer's personal information to third parties. Seller may share information with payment processors (Stripe), shipping carriers, manufacturers (for warranty registration), and service providers operating under confidentiality obligations.
10.3 Full privacy policy is available at autoliftserv.com/privacy.
10.4 If Buyer uses the AutoLift Services Chrome extension or any other Seller-provided software tools, additional terms apply as documented at autoliftserv.com/privacy.
11. Governing law and disputes
11.1 These Terms shall be governed by and construed in accordance with the laws of the State of Iowa, without regard to its conflict of laws principles.
11.2 Any dispute arising out of or in connection with these Terms or the sale of Products shall first be attempted to be resolved through good-faith negotiation between the parties.
11.3 If negotiation fails, disputes shall be resolved in the state or federal courts located in Story County, Iowa (Ames). Buyer consents to the personal jurisdiction of such courts.
11.4 The prevailing party in any dispute shall be entitled to recover its reasonable attorneys' fees and costs.
12. Force majeure
12.1 Seller is not liable for delay or failure to perform due to causes beyond its reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, government actions, tariffs and trade restrictions (such as the May 2026 Devon Industries surcharge), labor disputes, manufacturer production delays, supply chain disruptions, freight network failures, and pandemic-related restrictions.
12.2 In the event of a force majeure delay, Seller will notify Buyer promptly and work in good faith to minimize the impact.
13. Modifications to these Terms
13.1 Seller may modify these Terms at any time by posting an updated version on autoliftserv.com. Continued use of store.autoliftserv.com after modification constitutes acceptance of the updated Terms.
13.2 Orders placed before a modification are governed by the Terms in effect at the time of order.
14. Entire agreement
14.1 These Terms, together with the product-specific information on the storefront (specifications, manufacturer warranty documents, IOMs, and Fit Check assessments), constitute the entire agreement between Seller and Buyer.
14.2 No oral statements, prior course of dealing, or trade custom shall modify these Terms. Any modification must be in writing and signed by both parties.
14.3 If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
